Exeter networking organisations jointly support New Devon Business Expo

Two leading Exeter-based networking clubs are joining forces to be part of the new Devon Business Expo organised by thebestof Exeter with headline sponsor Basepoint Business Centres and Express & Echo as the official media partner.  The business exhibition launches on the 5th June at Matford Centre, Exeter with over 100 exhibitors and the capacity for 1000 delegates who can attend the event for free with pre-booking.  The Keynote Speaker is Michelle Downey Head of thebestof for the UK who will open the event which includes seminars and workshops.


Exeter Chamber of Commerce and Business Network (SW) together will be actively encouraging networking at the exhibition which is aimed at businesses from across the region and members of these business organisations will be eligible to 10% discount if they book a stand.

FOOTBALLING SUPERSTAR SIGNS EXETER CITY SHIRT FOR CHARITY

English former football player and manager, Kevin Keegan OBE took time out from a ‘Southern Sporting Club’ lunch presentation held at Sandy Park to sign an official Exeter City football shirt. The footballing legend aged 63 was the keynote speaker at the sporting lunch hosted by David Duckham MBE, the former Coventry and England rugby player.

The Yorkshire-born striker played for several clubs including Liverpool and Hamburger SV as well as being an England favourite. A football superstar of the Seventies, Keegan was as famous for his 'bubble' perm as much as his skills on the pitch.  He spent two seasons as a Newcastle United player and also had two spells as manager of ‘The Toon’.

Local PR consultant Glen King presented the City shirt to Kevin to sign on behalf of ‘The ‘Grecians’ to raise money for the club’s Football in the Community Charity.  Glen comments; “I have been attending David Duckham’s fabulous sporting events since the mid-nineties when I was working with Camelot, operators of The National Lottery.  I thought it would be a great opportunity to get a team shirt signed by a footballing superstar to raise much needed funds for the club’s award winning work in the community.  Kevin was both gracious and charming and very interested to see that Flybe is the club’s main sponsor. As part of his presentation he showed a picture of himself in his Newcastle strip on the Flybe Bombardier Q400 aircraft, which has the registration KKEV and flies between Newcastle and Gatwick.”

We named it after him back in July 2008, while he was in his second spell as Newcastle manager. It was an absolutely brilliant day and he is one of the most genuine people I’ve ever met.”

Exeter City FC Football in the Community works in collaborative partnerships to deliver inspiring physical activity, health and wellbeing and educational services for people of all ages across Devon. They work with 50,000 young people per year including homeless, young offenders, young people with addiction problems and in deprived areas.  They have 80 plus full time students at the club, wheel chair and blind footballers, ladies running clubs and football teams, teams for players with lower level mental challenges, multi sports coaching in small schools and so much more.

Building Site Manager wins National Award for challenging affordable housing project

Site manager Nathan Pyett from independent developer, C G Fry & Son has won a Considerate Constructors Scheme 2014 National Site Bronze Award.   Nathan received his award in London and was joined by his partner Julia Simmonds and Kevin Murch, Construction Director of C G Fry and his wife Teresa.  This award is in recognition of improving the image of construction and was for Holmdale site in Sidmouth built for DCH (formerly Devon & Cornwall Housing).

The Considerate Constructors Scheme's much-revered National Site Awards 2014, recognises and rewards the UK's most considerate sites that have raised the bar for considerate construction.  The National Site Awards are presented to the highest performing registered sites and are an opportunity for the industry to get together and celebrate its achievements in improving the image of construction.

Every award-winning site demonstrated a true commitment to considerate construction, and as a result, has greatly benefitted communities, the workforce and the environment. 
The scheme of 12 flats for shared ownership was constructed to Code for sustainable homes Level 3.  Built on a very confined site of a former motor workshop, later used as a gym, the apartments fit well architecturally into the town centre environment.
Designed by ARA Architects, construction by C G Fry started on site in August 2012 and work was completed on 24 January. The scheme, which cost just over £1million to deliver, attracted a grant of £175,488 from the Homes and Communities Agency.

I have praise and admiration for the way Nathan managed this challenging project.  The presence of a construction site can have a huge impact on the local community and Nathan liaised with all the home owners and businesses to ensure that respect and courtesy was given to those affected by the works.  As a result this helped to minimise the impact of deliveries, parking and work on the public highway.  Nathan could not have been more dedicated to this housing project and he highly deserves the recognition of this award for a job well done.”

East Devon District Council with partners DCH unveiled the 12 new affordable flats in Mill Street, Sidmouth available to purchase under a shared ownership scheme. The smart new Holmdale apartments are the result of a partnership agreement between the Council, which retains the freehold of the town centre site, and DCH, who manages affordable housing schemes across the South West.

South West Farming Consultancy warns farmers deadline for claiming Single Farm Payment looming

Haines Watts Rural Business is busy helping farmers across the region apply for the 2014 Single Farm Payment (SPS) which is due by the 15th May 2014.

The farming consultancy which assists farmers across the South West with grant funding applications and agricultural advice, understands that in 2015 paper claim forms will not be available and claims will have to be submitted via the new online claim system.

Crops planted in autumn 2014 will fall under the Basic Payment Scheme (BPS) rules when it begins in January 2015; the BPS rules include greening which contains crop diversification and ecological focus area’s which will affect some farms.

Charity celebrates coming of age at Business Expo

The Devon Business Expo organised by TheBestOf Exeter and launching on Thursday 5th June at Matford Centre, announces its ‘charity of the year’ Dream-A-Way, celebrating its 21st anniversary, as the designated show charity.  A charity raffle will be held to raise much needed monies for this local worthy cause at the after-show drinks reception sponsored by Business Network (SW).

The business exhibition sponsored by BasePoint Business Centres, supporting sponsor Glen King PR and Express & Echo as the official media partner, will have over 100 exhibitors showcasing their  products and services from across the region with a capacity of up to 1000 visitors at this one-day event.

The exhibition’s designed charity, Exeter registered Dream-A-Way, provides grants for holidays and day trips to people of all ages with any sort of disability who live in Devon, Cornwall and the Isles of Scilly.  With a loyal team of volunteers, the charity prides itself on giving all the monies raised by supporters to fund trips and do not take any funds for overheads or expenses.

The charity has helped over 10,000 local people since it was established in 1993.  Last year it enabled nearly 2000 individuals to enjoy a very special experience and days out.  Over 1200 guests enjoyed caravan holidays in Devon by the sea and 100 have fulfilled their dream holiday.

Exeter-girl Catherine who had a liver transplant 15 years’ ago when she was just a baby, was whisked away at the end of last year on a Dream-A-Way holiday to Portugal.  She was joined by Dad Martin, mother Heather and her brother Ryan for a much needed family Christmas break.

She comments: “It was amazing being able to spend Christmas on the beach, we even made a snowman, well a sand man! I jumped into the freezing cold swimming pool and splashed around in the glorious sea. My amazing experience was all thanks to the wonderful Dream-A-Way team.  The trip marked the 15 year anniversary of my liver transplant which I celebrated in December 2013 and it was the best way I could have marked it, ever.  Dream-A-Way for me has been like the tooth fairy, I may have had a tough time but when I look under my pillow, as if by magic, life has a new silver lining and that’s all thanks to the Dream Team”

Ten Ways to Reduce Your Capital Gains Tax Liability

With changes to pension rules reducing the amount we can save for our retirement, it’s more important than ever to make the most of those assets we have managed to acquire

Capital Gains Tax (CGT) is a tax that may be charged on the profit or gain made when selling, gifting, transferring, exchanging or disposing of an asset. There are a number of assets, such as your home, and any personal belongings worth less than £6,000, that are exempt from CGT. However, assets such as shares, collective investments and second properties that generate a capital gain are generally liable to CGT. Each individual has a personal CGT allowance every year (6 April to 5 April), which for many investors is sufficient for avoiding a CGT liability. Any gains in excess of the allowance are charged to CGT at either 18% or 28%, depending on the individual’s other total taxable income in the year the gain arises. Although the current CGT rates are historically low (CGT has been charged at 40% in recent years) and many individuals will never pay it, there are a number of ways in which CGT can be reduced or even removed altogether.

1. Make use of the CGT Allowance
Every individual has an annual CGT allowance which currently lets them make gains on investments of up to £10,900 free of tax. If unused, the allowance cannot be carried forward into the next tax year, so it is advisable to use this tax-free allowance each year in order to reduce the risk of incurring a significant CGT bill in subsequent years.

2. Make use of losses
It might be wise to sell some assets at a loss if the overall gain in the tax year exceeds the annual allowance. Gains and losses established in the same tax year must be offset against each other, so will reduce the amount of gain that is subject to tax. Losses must be registered with HMRC within four years from the end of the tax year in which the loss has occurred.

3. Transfer assets to your Spouse or Civil Partner
Transfer between spouses is currently exempt from CGT. This means that assets can be transferred between husband and wife or civil partners so that both annual CGT allowances are used. This effectively doubles the CGT allowance for married couples and civil partners. The transfer must be a genuine, outright gift.

4. Bed AND Spouse
In the past it was possible to use up some of your CGT allowance by selling shares on which you had a gain, and then buying back the same shares the next day; this was known as ‘bed and breakfasting.’ However, investors are no longer allowed to buy back the same shares within 30 days if they intend to crystallise a capital gain. Spouses or civil partners are permitted to buy back the shares sold by their spouse or civil partner immediately, so the gain is realised CGT free while enabling the family to retain the assets.

5. Invest in an ISA/Bed AND ISA
Gains (and losses) held within an ISA are exempt from CGT so it makes sense, particularly for higher rate tax payers, to utilise the ISA allowance each year. From April 2014, an individual aged over
18 can invest up to £11,880 in a Stocks and Shares ISA. From July 2014, there will be a single new ISA (a NISA) of up to £15,000, which can be invested in stocks and shares or cash. This means that a married couple, or civil partners, can invest up to £30,000 per annum in this tax-privileged investment. Over many years, some investors have built up multiple six-figure sums in ISAs by utilising their allowance each year.
As with the bed and spouse option, a bed and ISA involves selling assets to realise a capital gain and then immediately buying back the same assets inside an ISA. This enables all future gains on the asset to be CGT free.

6. Contribute to a Pension
By making a pension contribution (where one has net relevant earnings), the tax on a capital gain can be reduced from 28% to 18%. A pension contribution extends the upper limit of an individual’s income tax band by the amount of the gross contribution. For example, if an investor is able to make a gross pension contribution of £10,000, the point at which higher rate tax becomes payable will increase from £41,865 (limit for 2014–2015) to £51,865. If the capital gain, once added to the other taxable income in the year the gain is realised, falls within the extended personal allowance, the CGT liability will become 18% instead of 28%.

7. Give shares to charity
If one gives land, property or qualifying shares to a charity, or sells them to a charity at less than the market value, income tax relief and CGT relief are available.

8. Invest in an EIS
Any gains that are made on investments in an EIS (Enterprise Investment Scheme) are free from CGT if held for three or more years. If the shares are disposed of at a loss, one can elect for the amount of the loss, less any income tax relief given, to be set against income for the year in which the shares were disposed of – or any income for the previous year – instead of being set against capital gains.
CGT deferral relief is available to individuals and Trustees of certain Trusts. The payment of tax on a capital gain can be deferred where the gain is invested in a share of an EIS qualifying company. The gain can arise from the disposal of any kind of asset, but the investment must be made within the period of one year before or three years after the gain arose. There is no minimum period for which the shares must be held; the deferred capital gain is brought back into charge whenever the shares are disposed of, or are deemed to have been disposed of under the EIS legislation. The downside of EIS is that generally these types of schemes are higher risk than traditional stocks and shares.

9. Hold over Relief
Hold over relief is available on certain assets. Where hold over relief is claimed the chargeable gain is postponed, usually until the transferee disposes of the assets.
Hold over relief may be claimed for:
• Gifts of business assets
• Gifts of unlisted shares in trading companies etc.
• Gifts of agricultural land
• Gifts which are chargeable transfers for inheritance tax (IHT) purposes
• Certain types of gifts which are specifically exempted from IHT

10. Chattels that escape CGT
Possessions such as antiques and collectibles are called chattels. Gains on some are tax-free. Items with a predicted life of 50 years or fewer, known as ‘wasting assets’, are CGT-free, provided they were not eligible for business capital allowances. Antique clocks and vintage cars are treated as ‘wasting assets’. Pleasure boats and caravans also fall into this category.
If the gain is not tax-free, CGT is charged in a special way. The taxable gain is the lower of the actual gain or five-thirds of the excess of the final value over £6,000.

For example, if you sell an antique clock for £7,000 which you originally bought for £5,000, the actual gain is £7,000 - £5,000 = £2,000. The gain under the special rules is 5/3 x (£7,000 - £6,000) = £1,666.
Since this is lower, your taxable gain is £1,666.

Families from Children’s Hospice enjoy day out with Grecians courtesy of local professionals

The Exeter office of Brewin Dolphin, one of the UK’s largest independently-owned private client wealth managers, arranged a very special day out on behalf of their charity of the year, Children’s Hospice South West (CHSW) to visit Exeter City Football Club.

Children and families supported by Children’s Hospice South West were invited to watch Exeter City FC’s first team put through their paces at club’s training ground at the Cat & Fiddle and to meet the players.

 And it really was a day out for all the family as Jake Merritt (19) from Falmouth was joined by his grandfather, uncle and his cousin Lewis.  Ashleigh (20) who lives in Exeter was accompanied by her mother, grandmother, younger brother and sister and even the family dog, Max.  The sun shone as the families watched the football team train under the stewardship of manager Paul Tisdale, and Director of Football Steve Perryman, former English international football player who is best remembered for his successes with Tottenham Hotspur.
  
After the training session, the families enjoyed a hot lunch prepared by club volunteers.  This was followed by an autograph session for Jake and Ashleigh together with their siblings and an opportunity to meet each player. A delighted Jake was even presented with a pair of football boots signed by Grecian’s striker John O’Flynn.

The day concluded with a guided tour of St. James’ Park stadium given by Bruce Henderson, Business Manager for the club.

Mayor officially opens new show home on Exmouth development

Councillor John Humphreys; Mayor of Exmouth carried out an official ribbon cutting ceremony to open the new show home, a four-bedroom Town House, at a development in Exmouth.  Built by independent builders C G Fry & Son, ‘Hillcrest’ is located in the desirable St. John’s Road on the site of a former school.

Dairy farmers make sure you take care of your profits

Mike Feneley, Partner with Haines Watts Rural Business talks about the upsurge in profits for Dairy farming businesses and offers sound advice on how farmers can use these effectively over the coming year…

Dairy farming profitability is on an upward path due to better milk prices, better climatic conditions and more attractive costs of production giving great opportunities to the dairy farming community.  It is a time where businesses need to plan carefully to ensure they utilise any extra profits effectively for the future.  There is no doubt that there will be many suppliers to the dairy industry who will be licking their lips in anticipation of the sales that they can make due to the extra profits being made within the industry.  It is vital for any dairy farming business and for any business to ensure that those hard won profits are used efficiently to achieve their objectives.

Looking ahead to the next twelve months Mike recommends giving thought to the following:

-          When you are looking to the next twelve months firstly focus on the basics of running an effective and profitable dairy business, before you start adding extras.  For example, make sure that your soil PH is the correct level to make good use of your nutrients before you start buying a special trace element fertiliser.  There are many areas of a dairy business where you can get distracted by adding extras first. The most profitable dairy businesses focus on getting the basics right first.


-          Make sure whatever investment you are planning enhances the use of the assets you currently have available.  The assets you have available include your own likes and dislikes in terms of the type of system you like to run.  Remember if a businessman enjoys what they are doing because the system they are operating suits them, then they will always achieve the better results.

-          Be careful in your investments to ensure that they do not add extra complexity to your existing farming business.  In my experience adding complexity to a business often adds extra cost that doesn’t necessarily create any extra margin.  Try to keep things simple and streamlined in whatever farming system you are running to get the best possible results from your efforts. Make sure your investments are fully researched, getting guidance from independent people who have experience in that area.

-          Focus your investments on achieving your own business and personal goals.  Do not get distracted by investing in your business based on fads and fashions that others may try to sell you.

-          When making additional profits if there are not obvious investments you need to make consider building financial strength by either debt repayment or building your credit balances.  This may sound a little old fashioned but it is far better to build financial strength in a business than it is to spend on capital investment that may not be appropriate for your farm at that specific time. Remember that investments in a buoyant period are often more expensive. Always make sure your business is financially strong before any potential downturn as there are often better value investments in those periods.

-          When you are contemplating your investments for the future work closely with your accountant to ensure that they are purchased in the most tax effective way.  Remember to make the decision on a commercial basis first and then get the tax situation sorted after you have made the right commercial decision.

Limitation issues in professional negligence claims
John will cover limitation periods for the misconduct of litigation and limitation issues in lenders’ negligence claims.




Professional negligence in construction contracts
This will be a discussion of the duties of care owed by architects, surveyors and engineers in administering building contracts, issues of ostensible authority which arise when they act for corporate clients, and negligent overvaluation.



Causation, mitigation and solicitors who continue to act after being negligent
Guy will address recent developments in the law relating to the court’s approach to questions of causation and mitigation, and in particular as to how the burden of proof shifts. He will pay particular attention to a solicitor’s professional obligations, if he appreciates that he may have been negligent, and the practical problems that arise from continuing to act in such circumstances.


Negligent tax advice and disappointed beneficiaries: the extent of White v Jones Liability
The full implications of the House of Lords’ decision in 1995 have still not been worked through. Drawing upon recent case law, George Rowell will consider whether liability for professional negligence can exist in the following common situations: 1) A claim by a deceased person’s heirs arising from negligent tax-planning advice given to the deceased during his lifetime; 2) A claim by the beneficiaries of an inter vivos trust arising from negligence on the part of the advisors retained by the settlor to establish the trust.
